The client, asking to voluntarily participate in classes or training at Ever Fit hereby agree as follows:
1. That I am participating in classes and instruction offered by Ever Fit, LLC, during which I will receive information and instruction. I recognize that classes require physical exertion that may be strenuous and may cause physical injury, and I am fully aware of the risks and hazards involved.
2. I understand that it is my responsibility to consult with a physician prior to and regarding my participation in the classes or training and I represent and warrant that I am physically fit and I have no medical condition that would prevent my full participation in such classes or training.
3. In consideration of being permitted to participate in classes at Ever Fit, LLC, I agree to assume full responsibility for any risks, injuries, illness, disease or damages, known or unknown, which I might incur as a result of participating in the classes. Further, I do hereby release, waive, discharge and covenant not to sue and to hold harmless Ever Fit, LLC or its representatives from any liability and any and all claims from injury, illness, disease or damages suffered arising from negligence of Ever Fit, LLC or its representatives and relating in any way to participation and/or travel before, during or after classes.
4. COVID-19 is a respiratory disease that can result in serious illness or death, is caused by the SARS-CoV-2 virus, which is a new strain of coronavirus that had not been previously identified in humans and can easily spread from person to person. The virus is spread between individuals who are in close contact with each other (within about six feet) through respiratory droplets produced when an infected person coughs or sneezes. It may be possible that individuals can get COVID-19 by touching a surface or object that has the virus on it and then touching their own mouth, nose, or eyes. Our equipment and facility is regularly cleaned and Ever Fit, LLC follows suggested guidelines for best practices for our equipment and facility.
5. I agree that Ever Fit offers fitness services with no guarantee of results. I agree that I am solely responsible to maintain that diet and fitness regime appropriate for my level of health and stamina, and I agree that any results that occur, whether positive or negative, are the effects of my own personal choices.
6. I agree that participation is not a replacement for actual medical care, and that if I do experience medical issues, I will contact my doctor immediately.
7. I agree and verify that all of the information that I have given Ever Fit, LLC and its representatives is accurate, up-to-date, and without the omission of any known medical issues.
8. I agree and verify that if I have omitted and necessary personal information, knowingly or unknowingly, I will hold Ever Fit, LLC harmless against all liability for any damages that may occur to myself or others because of my actions or inactions.
9. I agree to keep Ever Fit, LLC apprised of any changes or upcoming changes concerning my physical health and personal information.
10. I understand and agree that it is my responsibility to let Ever Fit, LLC know if I find myself in any pain or discomfort before, after, or during the classes.
11. If I do require medical treatment or attention while or after participating in the Ever Fit, LLC classes I agree that the medical costs are mine and mine alone and hold Ever Fit, LLC blameless from any charges, fees, or costs that my conditions may incur.
This fitness services waiver will bind and be enforceable against me and all of my personal representatives. I agree that this fitness services waiver should be enforceable to the fullest extent of the law, and if any portion is held invalid, the remainder should continue in full legal force and effect. I specifically acknowledge and agree that this document is not intended to be a general release, which would be limited under some state and local laws. This fitness services waiver shall be construed and interpreted as broadly as possible in the applicable jurisdiction.
I have read the above fitness services waiver fully and I understand and agree to its contents. I understand and agree that by signing this fitness services waiver I forfeit any right, claim, or ability to hold Ever Fit, LLC responsible for any tangible or intangible damages, loss of property, or loss of life that may occur during or after my use of the facilities and participation in Ever Fit, LLC services.
